When applying for different Chinese visas, especially work permits, we need to provide many valuable documents, such as proof of no criminal record, physical examination certificate, labor contract, work experience certificate, etc.

Labor contract

The labor contract proves the labor service relationship between the foreigner and the Chinese employer. When applying for a work permit, there are several points in the labor contract that need special attention:

-- How to fill in the start date of the labor contract?

If you apply for a work permit in China, the date of the employment contract should be one week earlier than the date of application.

If you apply for a work permit in China from abroad, notice: The date of the labor contract shall not be earlier than the date of application submission.

If you want to renew your work permit and need to sign a new employment contract, the start date should be no later than the current work permit expiration date.

-- Is there a limit on the Term of the labor contract signing?

The term of the labor contract shall not be less than six months; In addition to the start date, the contract should also have a precise end date, can not sign an open-ended contract.

Resignation Letter

When you change your job or get into the new company to work in China, you need to submit the resignation certificateof your previous job, no matter whether you cancel your work permit or apply for a work permit under the name of the new company.

--When should I go to the Immigration Dept,. to cancel my work visa?

If A foreigner resigns from their original company, they should go to the Exit and Entry Administration department for the cancellation or alteration of their residence permit within ten days from the resignation on the resignation certificate. There is no need to wait for a successful work permit cancellation.

Non-criminal Record

-- How long is the  non-criminal record valid?

Normally, six months !

-- Do I need a new one when I change my company in China?

In principle, the work-type residence permit can be exempted from providing proof of no criminal record during the validity period;

If the foreigner changes their employer, the Immigration Dept., has canceled their work-type residence permit and replaced it with a stay visa;

If a foreigner has not left China and their work residence permit has been revoked within one month, they may also be exempted from providing proof of non-criminal record.

Work Permit

-- When should work permit are extension applications initiated?

Earliest start time: 3 months before the validity of the applicant's work permit

But the good news is that

During the pandemic, many cities relaxed restrictions: they temporarily lifted the "extension application must be submitted 30 days before the expiration of the permit" limit.
