A Chinese man, Liu, from Suzhou City, Jiangsu Province, won a case against the company he joined for being fired over not being able to run 5 kilometres in 30 minutes in 40 degrees Celsius heat.

The company, whose name has been withheld, stipulated that new employees complete a 5-kilometre run within 30 minutes, and that failure to do so means that they did not meet the conditions for employment with a “serious work spirit.”

Liu had applied for a job in the company's mechanical parts department, and after passing a series of practical tests that included electric welding and gas cutting, he got the job.

After paying for the medical exam out of his own pocket, Liu started working for the company as a maintenance worker, not knowing that he still had another big test to pass.

After his appointment, Liu was told that he had to participate in the long-distance running test. His teammates warned him that this was not a joke and that failure to run the full 5 km in the allotted 30 minutes would definitely lead to his expulsion, but he did not have time to train.

And the worst was yet to come. On the day of the test, the temperature was 40°C.

Liu claims that after running 800 metres under the scorching sun, he began to suffer symptoms similar to heatstroke and gave up. Instead of finishing the race, he went back to work, and the next day, he was notified that he had failed his probation and would be fired.

However, Liu did not accept the company's decision, and instead sued it for not informing him of the need to pass a physical fitness test before being hired, so his termination was illegal. The court agreed with Liu's assessment of the situation and ordered the company to pay $1,000 in damages.
